WHAT ARE YOUR CONCERNS?

HOW DO WE HANDLE A FAMILY LAW CASE?
First, we listen to our clients. We want to understand your needs. Are you seeking a divorce? We strive to promote the equitable nature of a divorce proceeding. What this means is that a divorce is not a typical adversarial proceeding and the courts do not treat it as such. In Colorado, a divorce is an equitable proceeding. This means that the overarching legal standard is fairness. The courts will try to determine a fair resolution to your case. Second, we communicate with you. We work with you and give you the tools to help you determine exactly what is fair for you. We use our best efforts to put together a comprehensive settlement agreement with your spouse based upon what you want, and relieve you from the stress and anxiety of the divorce process. We help you through the process, so that you can focus your future.
We will help you determine what is best for your children. Colorado courts will require that the parents present a parenting plan that meets the needs of your children. Each family unit is unique. We can put together the parenting plan that focuses on your children, and what is best for them, whether it is a shared parenting time arrangement or a plan which provides for sole custody.
We will calculate child support. Child support is based upon two factors: (1) The parents' combined monthly gross income; and, (2) The number of overnights for each parent. Colorado has a statutory formula for child support. It is very difficult to try to calculate child support without the assistance of an experienced family law attorney. We are experienced in calculating child support according to Colorado law and are familiar with the statutory adjustments that may be made under the law to the presumptive child support amount.
We will determine whether maintenance (alimony) applies to your case. Maintenance is not awarded in every case. Courts typically look for long-term marriages and disparity in income. Few cases merit a maintenance award. This is primarily because in today's economy, both parents are working full time jobs in order to make ends meet. There are, however, long-term marriages where one spouse has remained home raising the children while the other spouse has been the primary wage-earner. For those situations, maintenance may be appropriate for a considerable amount of time to allow the other spouse to become financially independent.
Are you seeking a modification of your child support or parenting time? For a change in child support, Colorado courts require a substantial change in circumstances justifying the modification. For a change in parenting time, Colorado courts determine what is best for the children. We can help you through this process, and advocate for your modification, based upon the most up-to-date applicable rules and laws in Colorado.
WHAT IS THE TIMELINE FOR A DIVORCE
In Colorado, the court cannot enter a Decree of Dissolution of Marriage until ninety (90) days have elapsed from the date the Respondent (the other party) is served with the Petition for Dissolution of Marriage. We strive to resolve your case during that time period. The courts typically set a status conference once your case is filed, so that they can determine the needs of your particular case. Having an attorney at the status conference can be a comforting experience and will ensure that your case stays on track to reach a resolution as quickly as possible.
There are often urgent matters that need to be addressed once a case is filed and until the case concludes, such as financial support, where the parties should live, where the children should live, immediate agreements as to parenting time, payment of debt, insurance, etc. We do everything possible to address these concerns at the outset. If an agreement as to those issues cannot be reached in short order, we will ask the court for a temporary orders hearing. At a temporary orders hearing, the court will resolve these issues until it can make a final decision regarding the divorce and related concerns.
